These Terms of Service ("Terms") govern your access to and use of the Nuvex platform, website (nuvex.design), and related services (collectively, the "Service") operated by Nuvex ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of a business or legal entity, you represent that you have authority to bind that entity to these Terms.
2. Account Registration
To access certain features, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or are inactive for an extended period.
3. Description of the Service
Nuvex is an AI-powered platform that generates professional app store screenshot designs. You upload your app's screenshots and provide details about your app (name, description, category, etc.), and the Service uses artificial intelligence to produce multiple unique screenshot compositions — complete with custom backgrounds, headlines, typography, and device framing. These outputs are intended for use on the Apple App Store and Google Play Store.
Each generation request produces one or more screenshot designs (typically up to ten per request, depending on your plan). Credits are consumed per generated frame at a rate determined by the selected quality tier — see Section 4.1 and our Pricing page for the current rate. You can edit the generated designs (text, colors, layout) using the built-in editor before exporting; refining a frame consumes credits at the same per-frame rate as the original generation.
4. Credits, Plans, and Payment
4.1 Credit System
The Service operates on a credit-based system. Each generated screenshot frame consumes credits at a rate determined by the selected quality tier (Low, Medium, or High). Current per-frame credit costs are listed on our Pricing page. Credits are consumed at the time of generation and, once spent, cannot be recovered except as provided in our refund policy. Editing or refining a previously generated frame consumes credits at the same per-frame rate as generating a new frame.
4.2 Free Credits
New accounts receive a one-time grant of free credits upon signup. The current free grant is displayed on our Pricing page. No credit card is required. Free credits can be used to generate screenshots at any quality tier the user is entitled to, but previews generated using only free credits are displayed with a watermark and downloads are disabled until you complete a paid purchase (subscription or credit pack). Once you complete any qualifying paid purchase, all previously generated previews tied to your account become downloadable without the watermark. Free credits are granted once per person or entity; creating multiple accounts to obtain additional free credits is prohibited.
4.3 One-Time Credit Packs
You may purchase additional credits as one-time packs. Credit packs never expire and remain in your account until used. Pack sizes and pricing are listed on our Pricing page. We reserve the right to modify pack pricing; changes apply only to future purchases, not credits already owned.
4.4 Subscription Plans
We offer optional monthly subscription plans that provide a set number of credits per billing period. Subscription credits renew at the start of each billing cycle. Unused subscription credits do not roll over to the next period. Subscription details and pricing are described on our Pricing page.
4.5 Billing
All payments are processed through PayPal. You do not need a PayPal account — card payments are accepted. All fees are quoted in US dollars (USD). Subscriptions are billed automatically at the start of each period. Refunds are governed by our Refund Policy.
4.6 Cancellation
You may cancel your subscription at any time through your account page. Upon cancellation, you retain access to your subscription credits through the end of the current billing period. No partial refunds are provided for unused time within a billing cycle. One-time credit packs you own are unaffected by subscription cancellation.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Upload content that infringes on any third party's intellectual property rights, privacy rights, or other legal rights.
- Attempt to reverse-engineer, decompile, or extract the source code or underlying algorithms of the Service.
- Use automated tools (bots, scrapers, etc.) to access or interact with the Service without our prior written consent.
- Resell, redistribute, or sublicense the Service or access to the Service without authorization.
- Interfere with or disrupt the integrity, performance, or security of the Service.
- Upload or generate content that is obscene, defamatory, threatening, or otherwise objectionable.
- Circumvent any usage limits, authentication measures, or access controls.
- Create multiple accounts to obtain additional free credits or evade restrictions.
- Use the Service to generate misleading or fraudulent app store listings.
We reserve the right to suspend or terminate your access for any violation of this section, with or without notice.
6. Intellectual Property
6.1 Our Intellectual Property
The Service, including its design, code, AI prompts, algorithms, trademarks, and all related intellectual property, is owned by Nuvex and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without our prior written consent.
6.2 Your Content
You retain ownership of the app screenshots, app names, descriptions, and other materials you upload to the Service ("Your Content"). By uploading content, you grant us a limited, non-exclusive, worldwide license to process, store, and transmit Your Content solely for the purpose of providing the Service — including sending it to our AI processing partner to generate designs.
You represent and warrant that you have the right to upload Your Content and that it does not infringe on any third party's rights.
6.3 Generated Outputs
Subject to your compliance with these Terms, you are granted a non-exclusive, worldwide, perpetual license to use the screenshot designs generated by the Service ("Outputs") for your personal or commercial purposes, including submission to app stores. This license applies equally to outputs generated with free credits and paid credits.
We do not claim ownership of your Outputs. However, we reserve the right to use anonymized and aggregated data derived from usage of the Service to improve our AI outputs and the Service.
6.4 AI-Generated Nature of Outputs
All Outputs are generated by artificial intelligence based on your inputs. You acknowledge that:
- Outputs are AI-generated compositions, not human-designed artwork.
- The AI generates unique designs for each request — results are not templates and may vary between generations.
- Headlines, taglines, and other text generated by the AI should be reviewed for accuracy before use, as AI may produce errors or inappropriate content.
- You are solely responsible for reviewing, editing, and approving all Outputs before submitting them to app stores or using them in any other context.
- Nuvex does not guarantee that Outputs will comply with Apple App Store or Google Play Store guidelines. It is your responsibility to verify compliance.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure.
- AI-generated Outputs will meet your specific requirements, comply with app store guidelines, or be free of errors.
- Generated headlines, descriptions, or other AI-produced text will be factually accurate.
- Any defects in the Service will be corrected within a specific timeframe.
You acknowledge that AI-generated content may occasionally produce unexpected, inaccurate, or suboptimal results. You are solely responsible for reviewing and approving any Outputs before use.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NUVEX, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.
9. Indemnification
You agree to indemnify, defend, and hold harmless Nuvex and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your violation of these Terms; your violation of any rights of a third party; or any content you upload to or generate through the Service.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including how your data is shared with AI processing partners and other third-party providers.
11. Modifications to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
12. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:
- Your right to use the Service will immediately cease.
- Unused credits (both subscription and one-time pack) are forfeited and are not refundable.
- Any active subscription will be cancelled.
- We may delete your account data after 30 days, subject to legal retention obligations.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
13. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nuvex operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration body, unless you are located in a jurisdiction that requires a different dispute resolution mechanism.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Nuvex regarding the Service and supersede all prior agreements and understandings.
